1. INTRODUCTION

Welcome to the Verbena of your life. We want you to enjoy yourself and have a great time with us, which is why we recommend that you review the conditions of sale every time you visit our website verbenas.com to purchase any available product, as we may modify them without prior notice.

With these conditions of sale we regulate the agreement between us, FUN VERBENAS, SL., hereinafter "Verbenas", and you, "the Customer".

2. ORDERING PROCEDURE

2.1. USE OF THE WEBSITE

To place an order with Verbenas you must be of legal age (18 years or older) and be an end customer.

Minors are expressly excluded.

By using Verbenas to browse and place orders, as a Customer, you undertake to:

  • Use the Website to browse it or to place legally valid orders.
  • Not place any false or fraudulent order.
  • Provide us with your email address, postal address and/or any other information that may be necessary for the correct processing of the order truthfully and accurately.
  • Likewise, you consent to our use of such information in accordance with the Privacy Policy.

2.2. PLACING AN ORDER

To place an order through the Verbenas Website you must follow these steps:

  1. Choose the product you want and add it to "My cart".
  2. Proceed to checkout.
  3. Enter the delivery and payment information.
  4. Choose the payment method and click the "Submit Order" button; by doing so, you fully and unreservedly accept all the Conditions of Sale shown on the Website at the time of contracting.
  5. Click "Pay now".
  6. Make the payment.
  7. If the payment is authorised, you will receive an email confirming receipt of the order. This order receipt confirmation constitutes Verbenas' acceptance of the order placed and represents a binding contract between the Customer and Verbenas.

We recommend that you print and/or save a copy of the Conditions of Sale when placing the order, as well as of the order receipt confirmation.

2.3. PRODUCT AVAILABILITY

The acceptance of an order through Verbenas is subject to the availability of the products. Verbenas tries to guarantee the availability of all the products on sale on the Website.

If the Product is not in stock at the time of purchase, we will contact you immediately by email and the amount paid will be refunded using the same payment method used.

3. PRICES, CURRENCIES AND TAXES

The prices and promotions shown on Verbenas are in euros and include VAT (Value Added Tax) on all shipments within Spain and Europe.

Product prices do not include shipping costs, which will be added to the total amount due and indicated at the time of placing the order.

The prices and promotions presented on Verbenas are valid only for distance orders placed through the site verbenas.com

4. PAYMENT METHODS

Verbenas only accepts payments made by credit or debit card: Visa, Visa Electron, MasterCard, Bizum or PayPal. The charge will be made after the order is confirmed.

In certain cases the credit card may be declined for one of the following reasons:

- Check the expiry date of your card.

- The credit/debit card may not be enabled for distance purchases. Contact your bank.

- You may have exceeded your credit card limit.

- You may have entered some incorrect information.

5. DELIVERY

Orders will be delivered Monday to Friday, on working days. No deliveries are made at weekends or on local public holidays.

To facilitate deliveries, we will need work addresses or other addresses where someone can receive the parcel.

We will consider delivery to have been made at the moment the customer, or a third party duly designated by the customer, acquires physical possession of the products, which will be evidenced by signing for receipt of the order at the delivery address indicated by the customer.

6. DELIVERY TIMES

At Verbenas we work with the carrier GLS.

For Spain, orders will be delivered within 2 to 4 working days.

We will try to get your order to you as soon as possible, but Verbenas cannot guarantee the punctuality of the carrier once the parcel has been handed over.

When your order has been dispatched, you will receive a confirmation email from Verbenas.

For all other locations to which Verbenas Shoes ships, the delivery time will be 72-96h.

7. SHIPPING COSTS

Shipping costs will be applied to each Verbenas order as follows:

Shipping Costs for orders within the Iberian Peninsula will be FREE.

For the Balearic Islands they will be €4.95 for orders under €100. For orders over €100 they will be FREE. 

For Europe: if the purchase amount is under 100 Euros, shipping costs will be 6.95 Euros. If the amount is higher, shipping will be free.

8. RETURNS POLICY

8.1. Right of withdrawal

Users shall have a period of fourteen (14) calendar days to make exchanges or returns from receipt of the product, or even before receiving it, in accordance with the provisions of Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers (hereinafter, LDGCU) and Users and other complementary laws. Once this period has ended, declarations of withdrawal from product purchases will not be accepted.

To exercise their right of withdrawal, the User must notify VERBENAS of their intention to return the product by sending an email to the following address hello@verbenas.com

Once the User has notified their intention to return a product, they must send it together with the purchase receipt and the original packaging within fourteen (14) calendar days.

To meet the withdrawal deadline, it is sufficient for the communication regarding your exercise of this right to be sent before the corresponding period expires. However, the refund is subject to the correct receipt of the product being returned.

Once the corresponding communication from the User to exercise their right of withdrawal has been received, VERBENAS will carry out the appropriate procedures to process said request.

8.2. Consequences of withdrawal

In the event of withdrawal, VERBENAS will refund all payments received from the User without undue delay from the date on which VERBENAS has been able to verify that the Product meets the requirements to be subject to the right of withdrawal, for which it will have 3 working days. VERBENAS will make said refund using the same means of payment used by the User for the initial transaction and within a maximum period of 14 days.

Partial returns of an order will result in the refund of the proportional part of the price paid by the User for said order.

However, the User is informed that they will have to bear the shipping costs of the product being returned.

8.3 Returns

To request the return of an item, the User must indicate it in the following form

The User may return an item within a maximum period of 30 calendar days from the date of receipt of the order. Unfortunately, if this period is exceeded, the return cannot be processed.

VERBENAS informs you that the costs associated with the return are as follows:

  • Returns in Spain: 4.95 Euros.
  • Returns for the rest of the countries we ship to within the European Union: 6.95 Euros.

VERBENAS reserves the right to refuse returns notified or sent outside the established period, or items that are not in the same condition in which they were received by the customer.

The refund will be made within 1 to 15 working days from receipt at our warehouses. The refund will always be made through the same payment method used for the purchase and to the same bank account. During sales and holiday periods, this refund period may be extended.

To return a product, the User must follow these steps:

  1. Send an email with the subject DEVOLUCIÓN VERBENAS to hello@verbenas.com. The User must provide the order reference (a code made up of 9 letters) and the first name and surname of the person who placed the order.
  2. VERBENAS will reply to the User providing the necessary instructions together with the return label.
  3. Once VERBENAS receives the product, it will inspect the goods to check that everything is in perfect condition and will then refund the corresponding amount.

The User may return the purchased product, provided that:

  • The Product has not been washed or used in any way (except for reasonable wear resulting from checking and trying on the product)
  • The Product is complete (two items forming a pair must be returned together)
  • The Product is still sealed with the original labels.

Given the popularity/supply limitations of some VERBENAS Products, VERBENAS may have to limit the number of products available for purchase. VERBENAS reserves the right to modify the quantities available for purchase at any time, even after the order has been placed.

8.4 Return of defective products

If the User receives a defective product, they must contact VERBENAS as soon as possible, reporting the defect or flaw so that it can be checked.

The User must send an email to the address hello@verbenas.com with the subject PRODUCTO DEFECTUOSO, including in the body of the message their first name and surname and the order number together with a photograph of the product in poor condition.

VERBENAS will contact the User as soon as possible to manage the return of the Product.

Once VERBENAS has checked the condition of the Product, the full amount of the payment made, including shipping costs, will be refunded.

8.5 Product exchanges

VERBENAS does not carry out product or size exchanges. To do so, the User must return the unwanted product and place a new order.

8.6 Refund

All refunds will be made using the same payment method used for the purchase. VERBENAS will not make any refund until it receives the Product and verifies its condition and state at the warehouse.

Once these conditions have been verified, the User will receive, where applicable, a refund of the corresponding amount within fourteen (14) days of its receipt

9. APPLICABLE LAW

Purchases made through the Verbenas Website and under these Conditions of Sale are subject to Spanish law.

10. COMPETENT JURISDICTION

Any dispute or disagreement arising from the application or interpretation of the Conditions of Sale, as well as the contracts they incorporate, will be resolved in the courts of the city of Elche, Spain, which will have exclusive jurisdiction over any other jurisdiction.
