1. INTRODUCTION
Welcome to the Verbena of your life. We want you to enjoy and have a good time with us, so we recommend that you review the sales conditions each time you visit our website verbenas.es before proceeding with the purchase of any available product, since we may modify them without prior notice.

With these sales conditions, we regulate the agreement between us, FUN VERBENAS, SL., hereinafter "Verbenas," and you, "the Customer."

2. CONTRACTING PROCEDURE
2.1. USE OF THE WEBSITE
To place an order with Verbenas you must be of legal age (18 years or older) and be a final customer.

Minors are expressly excluded.

By using Verbenas to browse and place orders, as a Customer, you agree to:

  • Use the Website to browse or place legally valid orders.

  • Not place any false or fraudulent orders.

  • Provide us with your email address, postal address, and/or any other data necessary for the correct formalization of the order truthfully and accurately.

  • Likewise, you consent that we may use this information according to the Privacy Policy.

2.2. PLACING AN ORDER
To place an order through the Verbenas Website you must follow these steps:

  • Choose the product you want and add it to "My Cart."

  • Proceed to checkout.

  • Enter delivery and payment information.

  • Choose the payment method and by clicking the "Send Order" button, you fully and unreservedly accept all the Sales Conditions displayed on the Website at the time of contracting.

  • Click on "Pay Now."

  • Make the payment.

If the payment is authorized, you will receive an email confirming receipt of the order. This confirmation of receipt constitutes Verbenas' acceptance of the placed order and creates a binding contract between the Customer and Verbenas.

We recommend printing and/or saving a copy of the Sales Conditions when placing the order, as well as the confirmation of receipt of the order.

2.3. PRODUCT AVAILABILITY
Acceptance of an order through Verbenas is subject to product availability. Verbenas tries to guarantee the availability of all products on sale on the Website.

If the product is out of stock at the time of purchase, we will immediately contact you by email and refund the amount paid using the same payment method.

3. PRICES, CURRENCIES, AND TAXES
The prices and promotions shown on Verbenas are in euros and include VAT (Value Added Tax) on all shipments within Spain and Europe.
Product prices do not include shipping costs, which will be added to the total amount due and shown at the time of formalizing the order.

The prices and promotions presented on Verbenas are only valid for remote orders made through the verbenas.es site.

The subscription discount to the Verbenas Newsletter is not cumulative with any other discount or offer.

4. PAYMENT METHODS
Verbenas only accepts payments made by credit or debit cards: Visa, Visa Electron, MasterCard, Bizum, or PayPal. The charge will be made after order confirmation.

In some cases, the credit card may be declined for one of the following reasons:

  • Check the expiration date of your card.

  • The credit/debit card may not be enabled for remote purchases. Contact your bank.

  • You may have exceeded your credit card limit.

  • You may have entered incorrect data.

5. DELIVERY
Order deliveries will be made Monday to Friday on working days. No deliveries on weekends or local holidays.

To facilitate deliveries, we will need work addresses or other addresses where someone can receive the package.

We will consider that delivery has been made when the customer or a third party duly designated by the customer acquires physical possession of the products, which will be evidenced by signing the receipt of the order at the delivery address indicated by the customer.

6. DELIVERY TIMES
At Verbenas we work with the shipping company GLS.

For Spain, orders will be delivered within 2 to 4 business days.

We will try to get your order to you as soon as possible, but Verbenas cannot guarantee the punctuality of the shipping company once the package has been delivered.

When your order has been shipped, you will receive a confirmation email from Verbenas.

For the rest of the locations to which Verbenas Shoes ships, the delivery time will be 72-96 hours.

7. SHIPPING COSTS
Shipping costs will be applied to each Verbenas order as follows:

Shipping costs for orders within the Iberian Peninsula will be FREE.

For the Balearic Islands, shipping will be €6.95 for orders under €100. For orders over €100, shipping will be FREE.

8. RETURN POLICY
8.1. Right of Withdrawal
Users will have a period of fourteen (14) calendar days to make changes or returns from the receipt of the product, or even before receiving it, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers (hereinafter, LDGCU) and other complementary laws. After this period, withdrawal declarations for product purchases will not be accepted.

To exercise the right of withdrawal, the User must notify VERBENAS of the intention to return the product by email to the following address hello@verbenas.com

Once the User has notified their intention to return a product, they must send it along with the purchase receipt and original packaging within fourteen (14) calendar days.

To comply with the withdrawal period, it is enough that the communication relating to exercising this right is sent before the deadline expires. However, the refund is subject to the correct receipt of the product subject to return.

Once the corresponding communication is received from the User to exercise their right of withdrawal, VERBENAS will proceed with the appropriate procedures to process the request.

8.2. Consequences of Withdrawal
In case of withdrawal, VERBENAS will refund all payments received from the User without undue delay from the date VERBENAS has been able to verify that the Product meets the requirements to be subject to the right of withdrawal, for which it will have 3 business days. VERBENAS will proceed to make such reimbursement using the same payment method used by the User for the initial transaction and within a maximum period of 14 days.

Partial returns of an order will result in a proportional refund of the price paid by the User for that order.

However, the User is informed that they must bear the shipping costs of the product subject to return.

8.3. Returns
To request a return of an item, the User must indicate it in the following form.

The User may return an item within a maximum period of 30 calendar days from the date of receipt of the order. If this period is exceeded, unfortunately, the return cannot be processed.

VERBENAS informs you that the costs associated with the return are as follows:

Returns within Spain: 4.95 Euros.
Returns to other countries within the European Union we ship to: 6.95 Euros.

VERBENAS reserves the right to reject returns communicated or sent outside the established deadline, or items that are not in the same condition as when received by the customer.

The refund will be made within a period of 1 to 15 business days from receipt at our warehouses. The refund will always be made through the same payment method used for the purchase and to the same bank account. During sales and holiday periods, this refund period may be extended.

To proceed with a product return, the User must follow these steps:

  • Send an email with the subject RETURN VERBENAS to hello@verbenas.com. The User must detail the order reference (a code made up of 9 letters) and the full name of the person who placed the order.

  • VERBENAS will reply to the User providing the necessary instructions along with the return label.

  • Once VERBENAS receives the product, it will review the merchandise to verify that everything is in perfect condition before proceeding with the refund.

The User may return the purchased product, provided that:

  • The Product has not been washed or used in any way (except reasonable wear resulting from checking and trying the product).

  • The Product is complete (two elements that form a pair must be returned together).

  • The Product remains sealed with the original labels.

Given the popularity/limited offer of some VERBENAS Products, VERBENAS may have to limit the number of products available for purchase. VERBENAS reserves the right to modify the quantities available for purchase at any time, even after placing the order.

8.4. Return of Defective Products
If the User receives a defective product, they must contact VERBENAS as soon as possible reporting the defect or flaw to proceed with verification.

The User must send an email to hello@verbenas.com with the subject DEFECTIVE PRODUCT, including in the message body their full name and order number along with a photo of the damaged product.

VERBENAS will contact the User as soon as possible to manage the return of the Product.

Once VERBENAS verifies the Product’s condition, it will proceed to refund the full payment amount, including shipping costs.

8.5. Product Exchanges
VERBENAS does not carry out product or size exchanges. For this, the User must return the unwanted product and place a new order.

8.6. Refunds
All refunds will be made by the same payment method used for the purchase. VERBENAS will not make any refund until it receives the Product and verifies its condition and terms at the warehouse.

Once these conditions are verified, the User will receive, if applicable, the refund of the corresponding amount within fourteen (14) days from receipt.

9. APPLICABLE LAW
Purchases made through the Verbenas Website and under these Sales Conditions are subject to Spanish legislation.

10. COMPETENT JURISDICTION
Any dispute or discrepancy arising from the application or interpretation of the Sales Conditions, as well as the contracts they incorporate, will be resolved in the courts of the city of Elche, Spain, which will have exclusive jurisdiction over any other jurisdiction.
